1. Right of withdrawal

1.1. According to § 312g section 1 BGB, a consumer has a statutory right of withdrawal in the case of distance selling contracts for services in accordance with Section 355 BGB.

1.2. According to § 13 BGB, a consumer is any natural person who concludes a legal transaction for purposes that predominantly cannot be attributed to their com mercial or independent professional activity.

2. Declaration of withdrawal

2.1. The withdrawal is made by a declaration to the business. The declaration must clearly indicate the consumer’s decision to withdraw from the contract.

2.2. The withdrawal period is 14 days from the conclusion of the contract. The withdrawal period is 14 days from the conclusion of the contract.

2.3. The withdrawal does not need to contain a justification. The withdrawal can be made in any form (e.g., by letter, email, by phone). The consumer can also use the attached sample withdrawal form, although it is not mandatory.

3. Premature expiry of the right of withdrawal

According to § 356 section (4) Sentence 1 BGB, the right of withdrawal expires before the end of the withdrawal period if the entrepreneur has completely ful filled the service and has only begun to perform the service after the consumer has given their express consent and simultaneously confirmed their awareness that they will lose their right of withdrawal upon the complete fulfillment of the contract by the entrepreneur.

4. Consequences of withdrawal

4.1. The consumer and the entrepreneur are no longer bound by the contract if the consumer has revoked their declaration of intent within the stipulated withdrawal period.

4.2. After a withdrawal, the entrepreneur must reimburse payments received from the consumer. The entrepreneur must use the same payment method for the refund that the consumer used for the original transaction. This applies unless expressly agreed otherwise, and no costs are incurred by the consumer as a result.

4.3. If the consumer revokes a contract for the provision of services, the consumer owes the entrepreneur compensation for the services provided until the with drawal if the consumer has expressly requested the entrepreneur to begin the performance before the expiry of the withdrawal period.
